Abstract:The adjustment of the patent system for AI-generated technical solutions should shift its central concern from“AI autonomous inventions”to“AI-assisted inventions”.The latter is of greater practical significance,institutional advantage,and implementation efficacy in terms of technological cognition,resolution of institutional conflicts,and balancing of interests.The key to such institutional adjustment lies in how to establish a standard for identifying“human contribution”.At present,the Guidelines for Patent Applications for AI-Related Inventions(Trial)issued by the China National Intellectual Property Administration merely provide,in preliminary terms,that an inventor shall make a substantial contribution to the invention-creation.The revised Patent Examination Guidelines likewise lack specific standards and rules for determining human contribution.This paper examined the policies,reports,and other documents on patent protection for AI-related inventions issued or adopted by the United States,the European Union and its member states,including Germany,France,Poland,and the Netherlands,as well as the World Intellectual Property Organization(WIPO).A horizontal comparison in light of China's patent system was conducted based on the development needs of artificial intelligence.It argues that AI-generated technical solutions should,in principle,be presumed to constitute AI-assisted inventions.Among the substantial contribution standard,the overall contribution standard,and the supervision-and-control standard,the supervision-and-control standard is most instructive for China.In addition,China should draw on the experience of the United States and construct,within the existing legal framework,a mandatory information disclosure regime through the interpretation of the duty of candor and the enablement disclosure requirement.
