Abstract：The governance issues surrounding personal data generated by artificial intelligence are becoming increasingly prominent.The EU has focused on goal orientation,regulatory adaptation,institutional restructuring,and technological safeguard to establish a personal data governance system tailored for generative artificial intelligence.Based on the governance challenges faced by China,this paper reflects on and assimilates the experiences of the EU,proposing optimization pathways for China's personal data governance:exploring a personal data regulatory sandbox to establish procedures for pre-entry,in-process assessment,and post-exit,fostering dynamic synergy between personal data protection and secure usage;introducing a priority interest exemption rule to expand the legal basis for personal data processing and alleviate the challenges in applying informed consent;establishing a training data disclosure mechanism to enhance the adaptability and agility of personal data governance in response to the complexities of generative AI training demands;improving the technological governance system by promoting the coordinated development of technologies such as synthetic data,trusted computing,and anonymous evaluation to enhance the controllability and security of personal data during model operation.
