The Transformation Logic and Implementation Path of Data Element Governance Under the Regulatory Mode of Property Rights Confirmation

The property attributes of data elements are increasingly prominent,and the behavior regulation model centered on competition law cannot respond to the practical needs of data element circulation and profit distribution.Based on the theory of structural function,the regulatory model for property rights can achieve the economic value of data elements through the granting of various sub rights,while also ensuring personal justice,transaction efficiency,and data security.On this basis,by introducing the theory of separation of rights and clarifying the nature and positioning of new rights,legal support can be provided for the structural separation of data property rights under the model of property rights regulation.In terms of implementation path,in the data resource stage,it is necessary to focus on the original and subsequent acquisition methods of personal data ownership.In the data processing and use stage,the authority to process and use data can be divided according to the degree of originality.In the data product operation stage,the ownership,use,income,and disposal rights of data products should be refined.

Establishment of Result-Oriented Evaluation Indicator Framework for International Science and Technology Cooperation Program Evaluation——Based on Delphi and Analytic Hierarchy Process

The establishment of a result-oriented evaluation indicator framework for national international science and technology cooperation (program/fund)is conducive to comprehensively summarizing the implementation effectiveness,providing a scientific basis for administrations and management agencies to improve the (program/fund)management performance.This paper focuses on the accomplishments of the “Intergovernmental International Science and Technology Innovation Cooperation Key Program”within the National Key Research and Development Program.Based on the preliminary formulation of the program-level evaluation indicator framework,the Delphi is used to optimize and screen the indicators,and the Analytic Hierarchy Process is combined to determine the weights of the indicators,forming a result-oriented indicator framework.According to the research findings,the result-oriented indicator framework for international science and technology cooperation programs should prioritize program alignment with national strategies,focus on the benefits for both parties,and consider the sustainability of science and technology cooperation.

Research on Application Risk and Legal Regulation of Autonomous Vehicle Technology

Autonomous driving technology is one of the typical application scenarios in the field of artificial intelligence (AI).It will make a great significance to promote the improvement of China's legal system in the field of autonomous driving,analyzing the application risks of new technologies in the field of autonomous driving,comparing and drawing on the legislative practices of countries such as the United States,European Union and other typical countries in the field of autonomous driving.This study summarized five risk systems for technology application currently faced by autonomous driving:quality risks in automobile manufacturing,network and algorithm security risks,data and privacy risks,legal liability attribution risks,driving ethics and moral risks.In terms of legal regulation,the development of “soft law”in the field of autonomous driving in China is flourishing,while the development of “hard law”is lacking.In the future,we need to strengthen top-level design,establish a legal system for the general field of artificial intelligence,based on the principle of hierarchical supervision and prudence,strengthen the supervision of unique risks in the field of autonomous driving,strengthen international cooperation in talent,technology and other fields,and promote the upgrading of the autonomous driving industry,as well as the equal development of risk prevention and control supervision and legal regulatory relief.

Review and Prospect of Artificial Intelligence Governance Research in China

Exploring how to mitigate the social risks brought by artificial intelligence through governance reform,and promoting the true realization of trustworthiness,controllability,and usability of artificial intelligence,has vivid contemporary value and strong practical significance for promoting the sustainable development of the digital society.Based on the perspective of scientific knowledge graph,this study uses Cite Space software to conduct bibliometric and visual analysis of research literature in the field of artificial intelligence governance in the CNKI database.The existing research overview,research hotspot evolution,and research topic evolution are deeply deconstructed,providing a comprehensive and complete theoretical view for subsequent research in the field of artificial intelligence governance.The research conclusion shows the followings.①Research on artificial intelligence governance has shown a rapid growth trend since 2018 and the future upward trend is still strong;②There is a strong correlation between research on artificial intelligence governance and the development level of the artificial intelligence industry;③There is a large group of scholars in the field of artificial intelligence governance research,but a core author group has not yet been formed;④The evolution of research hotspots and themes in artificial intelligence governance presents a basic logic and structure of “new technologies,new fields,new risks,new concepts,new applications,and new governance”;⑤The evolution of research on artificial intelligence governance is an extension and expansion from new technologies to new risks,and from new concepts to new governance.

Key Core Technology Innovation Enables the Development of New Quality Productivity:Internal Mechanism,Important Procedures,External Support

Key core technological innovation is the fundamental driving force for the development of new qualitative productivity.Through the analysis of theoretical connotation,it is found that the key core technologies can promote the qualitative reshaping of the three elements of productivity,support the qualitative leap of productivity level,and effectively enhance the strategic value of new qualitative productivity.Relying on the logical context of “actively building bridges,improving development resilience,docking strategic tasks,and digital transformation and upgrading”,the key core technological innovation achievements have been effectively transformed,the industrial system has been safe and controllable,the comprehensive level of new kinetic energy has been improved,and the development of the digital economy has been accelerated.In order to ensure that all aspects of key core technological innovations' acceleration on the development of new quality productivity are accomplished orderly,it is necessary to build a government-industry-university-research consortium dominated by national strategic scientific and technological forces,establish a comprehensive R&D platform based on large-scale science and technology innovation parks,and create an inclusive and symbiotic environment dominated by multiple collaborative innovation networks,so as to strengthen external support from the three dimensions of participants,support platforms,and innovation ecology.In this way,the development of new quality productivity may gain continuous new momentum.

An Integrative Framework for Understanding Organized Research in Universities ——Analysing the Interactive Relationships Among Boundaries,Entities and Functions

Organized research in universities is a crucial form of scientific organization in the era of big science,which aims at solving complex problems and advancing technological development.Essentially,technological progress results from the expansion of knowledge and engineering boundaries,driven collectively by the government,industry,and academia.This requires not only internal functional coordination within universities but also collaboration with external entities.Changes in multi-agent collaboration methods are inherently linked to shifts in the internal functions of universities.Based on literature and theoretical research,this paper proposes an integrated analytical framework that includes the interactive relationships among agents,boundaries and functions.It seeks to reveal the collaborative mechanisms among the government,industry,and academia,as well as the corresponding adjustments in the internal functions and structures of universities,against the backdrop of new national demands for technological innovation in higher education.The paper argues that constrained by “danwei”system,scientific and technological funding and management systems,discipline directories,and administrative authority logic,universities cannot achieve “functional”transformation on their own.This hinders multi-agent collaboration and is detrimental to conducting organized research.To address this practical dilemma,government-driven institutional reforms are necessary to ensure internal functional changes in universities,thereby better facilitating internal and external collaboration in technological innovation.

Research on the Identification of Multi-agent Co-factor and Theoretical Logic in University Basic Research

As an important national innovation body,the development of basic research in university is closely related to the overall national basic research ability and scientific and technological innovation strength.The development of basic research in university is a process of collaborative participation of multiple subjects.Identifying the mechanism of multi-subject collaboration in basic research is the key to build a good innovation ecology and achieve high-quality development of basic research in universities.This paper builds a multi-agent collaboration mechanism for basic research in universities.Based on the rooted theory,it identifies the influencing factors of multi-agent collaboration from the perspectives of government,universities,researchers and social forces,and extracts four main categories:research foundation and era background,mission responsibility and interest demands,platform support and condition guarantee,internal power and external thrust.It constitutes the four basic elements of the theoretical model,namely,the basic elements,the mission elements,the guarantee factors and the driving factors,and constructs the theoretical model of the influencing factors of the multi-subject cooperation in the basic research of universities,so as to propose the policy enlightenment such as combining reasonable evaluation and increasing incentives,fully stimulating the role of social forces,and building the mechanism of the transformation of results.

Research on The Boom Index of Science and Technology Innovation in Large and Medium-sized Industrial Enterprises in China

Based on Schumpeter's innovation cycle theory,this paper constructs a systematic and dynamic prosperity index for scientific and technological innovation among Chinese enterprises using the synthetic index method,and conducts an in-depth analysis of its fluctuation characteristics.The results show that during the observation period,the prosperity index of scientific and technological innovation among Chinese enterprises exhibits significant and continuous fluctuations,with clear cyclical characteristics in terms of height,depth,and amplitude.These cyclical fluctuations demonstrate complex features of irregularity and asymmetry.Among the sub-indices of scientific and technological innovation in Chinese enterprises,all indices show a continuous upward trend;however,the growth of the economic output index is significantly lower than that of the scientific research output index.The results of trough-peak analysis and impulse response analysis reveal that the leading index precedes the coincident index by approximately four years,indicating a certain level of predictability for the coincident index.

Research on the Driving Strategies of Key Core Technology Breakthrough of High-Tech Manufacturing Enterprises from the Perspective of Configuration

Key core technologies are of significance in enhancing the core competitiveness of enterprises,and strengthening the comprehensive national power.Based on the Motivatiov-Opportunity-Ability(MOA)theoretical framework,64 Chinese high-tech manufacturing enterprises are taken as the research samples,and the fsQCA method is used to explore the influencing factors and driving paths of key core technology breakthrough.The results found the followings.①There are three types of configurations,namely motivation-opportunity double driven,motivation-capability double driven,and motivation-opportunity-capability integrated driven.②In the path of achieving high-level key core technology breakthroughs,cooperation network embeddedness or knowledge network embeddedness have key role,government subsidy is an important opportunity,and dynamic capability have a certain degree of complementary and substitutive relationship with continuous innovation capability.③When there are fewer conditions for the core existence,and when the conditions of motivation,opportunity and capability are missing,it is not conducive to high-level key core technology breakthrough.This study explores the driving path of enterprise key core technology breakthrough based on the perspective of configuration,which not only broadens the application scope of MOA theoretical framework,but also provides decision support basis for governments and enterprises to formulate and optimize the driving strategy of key core technology breakthrough.

Spatio-Temporal Evolution and Location Choice Differentiation of Multinational Corporations' R&D Investments in China

This paper uses the fDi Markets database to analyze the differentiation of spatiotemporal evolution and location choice of MNCs' R&D investment in China from 2003 to 2022 by distinguishing between research and development and using GIS spatial methods and conditional Logit models.The main findings are as follows.①The overall evolution of MNCs' R&D investment in China from 2003 to 2022 is non-linear and unstable,and has the characteristics of stage development,among which research investment accounts for a relatively low proportion,while development investment always occupies a dominant position.②MNCs' R&D investment in China is dominated by a few industry clusters such as ICT & electronics,life sciences and transport equipment,with obvious changes in industrial structure,among which the industrial concentration of development investment is higher than that of research investment.③Destination cities of MNCs' R&D investment in China mainly distribute in the eastern region with Beijing-Tianjin-Hebei,Yangtze River Delta,Pearl River Delta as the core,and there is a trend of scattering to a few cities in the central and western and northeastern regions,generally forming a northeast-southwest spatial pattern,in which the spatial evolution characteristics of research investment and development investment differ significantly.④Technology and knowledge innovation capability is the primary factors influencing the location choice of MNCs' research investment in China,while the level of market scale is stronger attracting investments in development activities.Meanwhile,economic development,industrial structure,foreign investment scale and other city attributes also have certain influence on MNCs' R&D investment in China.

Research on the Influence of Technological Dependence on Total Factor Productivity ——The Threshold Effect of Technology Gap

In recent years,technological dependence has become one of the major problems affecting the secure and stable development of China's economy and industry.To properly address the issue of technological dependence,this paper focuses on the influence mechanism of technological dependence.Based on the panel data of 30 Chinese provinces,municipalities and autonomous regions from 2003 to 2019,the study explores the influence of technological dependence on total factor productivity (TFP)and its spatial spillover effects,and analyzes the threshold effect of technological gap by using the panel threshold model,with the aim of providing theoretical insights for relevant policy decisions.It is found that technology-imported,imported,foreign-invested and outward-invested technological dependence,as well as the innovation investment,public education level,transportation facilities and the progress of urbanization have a significant positive impact on TFP.Technological dependence affects TFP in this region and other regions.As the technological gap narrows,the impact of technological dependence on TFP becomes more significant.Therefore,it would be beneficial to implement a more optimal combination of “bringing in”and “going out”,strengthen the development of inter-regional connectivity,increase investment in R&D,education,and infrastructure construction,and integrate development and security,so as to fully realize the positive effects of technological dependence.

Analysis on the Obstacles and Countermeasures of Adding Open License Provisions to the National Defense Patent Regulations

At present,China's defense science and technology achievements transformation work still faces practical problems such as low efficiency in transformation and application,and the widespread existence of idle defense patents.At the theoretical level,establishing an open licensing system helps to promote the transformation and implementation of patents from the institutional supply mode,realizing their economic value.At the institutional level,how the “Defense Patent Regulations”apply the open licensing rules introduced after the revision of the “Patent Law”has become a key issue that urgently needs to be resolved.By analyzing the basic principles of the patent open licensing system,and in conjunction with the background of the revision of relevant legal systems in China,this paper analyzes and demonstrates the necessity and feasibility of using the open licensing system in the defense patent system,and proposes a suggested plan for the defense patent open licensing system.

Re-discussion on the Degree of Unequal Allocation of Scientific Research Resources in China ——A Comparative Analysis Based on the Sampling Survey Data in 2008 and 2017

Based on the sampling survey data of national science and technology workers in 2008 and 2017,through measurement indicators and statistical methods such as the Gini coefficient and quantile measurement,this paper demonstrates the unequal situation and changing trends in the acquisition of funds among scientific research personnel during the process of China's science and technology system reform,and analyzes the factors influencing the acquisition of funds by scientific research personnel and the changes in their effects from three aspects:the individual,the organization,and the region.The study finds that the concentration degree of funds for scientific research personnel in China was relatively high in both surveys,but compared with 2008,the concentration degree in 2017 was somewhat alleviated.From the perspective of influencing factors,universalistic factors such as professional titles and educational backgrounds that reflect the individual scientific research strength had a significant impact in both years,and the impact effect of professional titles slightly increased.The influence of particularistic factors such as administrative positions was also relatively significant,but the impact effect had a significant decline;the differences among different unit types and unit levels were significant and showed an upward trend in the past decade.Further Shapley value decomposition results show that the explanatory power of individual-level factors of scientific research personnel for fund acquisition is decreasing,while the resource acquisition effect based on advantaged units and advantaged regions is strengthening.This finding indicates that the allocation model of scientific research funds in China became more reasonable from 2008 to 2017,and relevant reform measures have shown effectiveness.However,the issue of unbalanced resource allocation among different unit levels and different regions deserves attention in the future.

American and Western Patent Suppression and Penetration in China: Motivation,Measures and Risk Control

In the context of the great power game,the intellectual property competition with patents as the core has become an important part of the scientific and technological competition between the US and the West against China.To contain and suppress China's innovation and development,western countries led by the US,based on the strategic considerations of national security,economic development,political hegemony and other factors,have implemented multidimensional integrated repression of China's patent field from legislation,administration and justice.The US and the West engage in sensationalized infiltration by creating hot topics such as forced technology transfer and intellectual property theft,co-opt infiltration by allying with Western countries to establish an anti-China front,and induce infiltration by exporting benefits,lobbying and discrediting,thus bringing risks of technology decoupling,international reputation and international trade to China.Based on the signal theory and combined with the signal transmission process of patent suppression and penetration in China,this paper proposes three strategies for China's risk prevention and control of patent suppression and penetration in the US and the West.①Improve the ability of patent checks and balances,and open up a new situation of China-style intellectual property cooperation;②Form a “situational awareness”of patent suppression and penetration,and build a build a Chinese-style signal expression mechanism;③Improve the resilience of the industrial chain and supply chain,and take reciprocal countermeasures.

Implications of Three Types of French New R&D Institutions for China: Analysis from an Organizational Perspective

This paper,based on an organizational perspective,introduces the theoretical framework of organizational structure,organizational conduct,governance mechanism,and organizational performance.It selects 196 new R&D institutions,including Convergence Institutes,Laboratories of Excellence,and French Institutes of Technology,to conduct an in-depth analysis of the innovative mechanisms and practical experiences of the French government's differentiated and systematic layout of new R&D institutions.The aim is to provide reference for the healthy development of new R&D institutions in China.Research has found that in terms of organizational structure,French new R&D institutions are flexibly assembled according to needs,forming virtual research networks or entities with autonomous boards of directors.In terms of organizational conduct,they promote differential development and mismatched layouts around the innovation chain.Regarding governance mechanisms,they establish resource allocation,personnel,collaboration,and fund management mechanisms that are compatible with mixed organizational conduct.In terms of organizational performance,they implement differentiated assessments,with indicators not pursuing “broad and comprehensive”coverage,and linking assessment results with funding rewards.The research results can provide experiential references for China to promote the healthy development of new R&D institutions from a sustainable and long-term perspective.

Research on EU Artificial Intelligence Strategy Based on DTM Model:Hotspots,Evolution and Deconstruction

The European Union is an important force in the international artificial intelligence competition.A systematic analysis of the EU's artificial intelligence strategy is helpful to grasp its strategic development context and its phased evolution characteristics,and to clarify the deep-seated factors that affect the EU's strategic choices.At the same time,the EU's exploration of artificial strategy is the product of its experience in coping with the development of emerging technologies and the scientific and technological competition of major countries,which can provide a mirror for China to promote artificial intelligence governance,respond to industrial development challenges,and optimize strategic path design.This paper uses a dynamic topic model to track the dynamic topics of 79 strategic guidance texts released by the EU since 2016,and deconstructs the EU's artificial intelligence strategy based on international strategic theory.The study found that the overall theme of the EU's artificial intelligence strategy is presented in two dimensions:technology regulation and technological innovation.Among them,the hot topics are concentrated in digital markets,rights laws,international competition,etc.,and the strategic focus is gradually shifting to the construction of artificial intelligence legal system based on technology regulation,and the color of international competition is gradually emerging.The EU's strategic choice is the result of a comprehensive consideration of regional interest goals,its own power resources,and internal and external environments.The underlying logic of its strategy reveals its resolute maintenance of the EU digital single market,which is of enlightenment significance to China.

Is Ability the King or Flow the First:A Study on the Factors Influencing the Output of Global Science and Technology Think Tanks

Science and technology think tank is the operator and vane of national science and technology information service provision and science and technology ability improvement.Systematically sorting out the factors affecting the output of science and technology think tank is of positive significance for the rational planning and scientific development of science and technology think tank in China.Based on the theoretical framework of information ecosystem and Delphi method,this paper constructs a system of influencing factors for the achievement output of science and technology think tanks.58 science and technology think tanks around the world are selected as empirical research objects,and QCA method is adopted to determine the univariate necessity and condition combination path of influencing factors for the achievement output of science and technology think tanks.Based on the configuration results obtained from the empirical analysis,the main problems existing in the output of science and technology think tanks in China are sorted out and countermeasures are proposed.The results show that:①The output of science and technology think tank is influenced by a variety of condition variables;②High-output science and technology think tanks can be summarized into two types of path types:independent display type and external attraction type;③To enhance the output of science and technology think tanks,it is necessary to consolidate the foundation of content effectiveness with “capacity building”as the core,and build brand influence with “communication and innovation”as the guidance.Think tank survival emphasizes “ability is king”, think tank development pays attention to “flow first”.
