Abstract Autonomous driving technology is one of the typical application scenarios in the field of artificial intelligence (AI).It will make a great significance to promote the improvement of China's legal system in the field of autonomous driving,analyzing the application risks of new technologies in the field of autonomous driving,comparing and drawing on the legislative practices of countries such as the United States,European Union and other typical countries in the field of autonomous driving.This study summarized five risk systems for technology application currently faced by autonomous driving:quality risks in automobile manufacturing,network and algorithm security risks,data and privacy risks,legal liability attribution risks,driving ethics and moral risks.In terms of legal regulation,the development of “soft law”in the field of autonomous driving in China is flourishing,while the development of “hard law”is lacking.In the future,we need to strengthen top-level design,establish a legal system for the general field of artificial intelligence,based on the principle of hierarchical supervision and prudence,strengthen the supervision of unique risks in the field of autonomous driving,strengthen international cooperation in talent,technology and other fields,and promote the upgrading of the autonomous driving industry,as well as the equal development of risk prevention and control supervision and legal regulatory relief.
