Abstract：Digital finance is a disruptive financial industry that deeply integrates digital technologies such as blockchain and smart contracts,which is of great significance to activate the new quality productive forces.Technical guidance has also brought great challenges to financial regulation when achieving the goal of safety,efficiency,transparency and openness,and comprehensive governance.How to integrate technical governance with legal governance,how to achieve precise regulation in the virtual and real space,and how to demarcate the pluralistic private rights formed based on the code architecture are the crux of the current institutional regulation.The theory of technical governance,which emphasizes the coherent governance of technology and law,contributes a complete and clear scheme,and provides ideas and directions for the logic transformation of digital financial regulation.Through the refinement and analysis of this theory,a digital financial regulatory scheme that integrates technological governance can be derived.In accordance with the basic principle of cooperation of technology and law,exploring the hierarchical and functional regulation model,supplemented by the necessary external authority,internal governance and ethical guidance,which can optimize the regulation of digital finance.
