Research on the Institutional Framework for Data Property Rights Registration in the Context of a Unified National Market:A Grounded Theory Analysis Based on 82 Policies

Abstract:To overcome institutional barriers hindering the flow of data elements in building a unified national market,it is imperative to advance the systematic development of a data property rights registration system.Using grounded theory methodology,this study conducted a three-level coding analysis of 82 policy documents,constructing a four-dimensional theoretical model,namely “registration type-registration procedure-management and supervision-systemic governance”,to reveal the dynamic interrelationships among institutional elements.The study finds that defining registration types is the prerequisite for implementing registration procedures.Government oversight should shift from direct control to a regulatory role that builds trust.Networked collaboration and value co-creation within the social system governance framework are the core drivers of procedural effectiveness.Currently,China's data property rights registration faces challenges including inconsistent registration procedure standards,unclear delineation of legal responsibilities,and relatively weak system governance.Future efforts should establish a unified national registration procedure,clarify the boundaries of legal responsibilities for all participating entities,and build a collaborative governance registration system to enhance the overall governance effectiveness of the national integrated data market.
