The Paradox of Digital Environment Governance in the Buliding of Computing Power Infrastructure and Its Solution: An Exploration of the Legal Approach Under the Technological Rebound Effect

Abstract:Amid the rapid advancement of large-scale AI models,the development of computing infrastructure—while essential for supporting AI growth—has also introduced environmental governance challenges under the Jevons Paradox.Improvements in technological efficiency have intensified energy consumption,carbon emissions,and electronic waste from data centers and other infrastructure.Legal intervention can effectively mitigate the risks of negative environmental externalities.Governance entities represented by the European Union have adopted a dual transformation regulatory approach,pioneering mechanisms such as climate disclosure mandates,stringent energy efficiency standards,and Extended Producer Responsibility designed to internalize environmental costs.However,institutional tensions persist between digital economic development and ecological protection.To synergize digital transformation with green development,China should accelerate the integration of sustainability policies into legal frameworks and establish an environmental supervision system covering the entire lifecycle of computing infrastructure.Differentiated regulations should be strengthened for the construction,operation,and decommissioning phases.Moreover,while enhancing oversight,adequate space for technological innovation should be retained to promote green and low-carbon development of computing infrastructure.This would facilitate the synergy between digitalization and sustainability,contributing to global sustainable development goals.
