知识产权“内卷化”竞争及面向“产权生态主义”的三维规制

摘要 “产权中心主义”影响下的知识产权市场陷入“内卷化”竞争困局,亟须探索复归理路。知识性组织经营目标发生战略性逆转,它使用防御性竞争替代进攻性的外部开拓,将创新资源投入非生产性领域。知识产权“内卷化”竞争使行业创新出现“以量代质”的非理性异化;创新生态内向挤压导致创新生态封闭、产业收益分配失衡和社会资源错配;世界知识产权治理的“巴尔干化”与“知识产权鸿沟”加剧全球知识产权治理工具失效。进行“产权中心主义”到“产权生态主义”的价值转向,引导世界知识产权竞争良性复归。建议开展微观行为矫正,构建“质量—贡献”导向的行为激励机制,用“技术实质性”标准替代“创造性”标准;进行中观规则设计,建立“竞争—合作”的知识产权创新生态,统筹创新生态链中的收益分配机制;开展宏观政策改革,使用“多元—发展”治理体制推动全球知识产权治理体制转向发展导向型。

Abstract：Under the influence of property rights centrism,the intellectual property market has fallen into a competitive dilemma of involution,and urgently needs to explore a path of recovery.The business objectives of knowledge-based organizations have undergone a strategic reversal,replacing aggressive external expansion with defensive competition and investing innovative resources in non-productive areas.The involution competition of intellectual property rights has led to the irrational alienation of industry innovation,where“quantity replaces quality”.The involution of the innovation ecosystem leads to the closure of the ecosystem,imbalanced distribution of industrial benefits,and misallocation of social resources;The Balkanization and Intellectual Property Gap in global intellectual property governance exacerbate the ineffectiveness of global intellectual property governance tools.To shift the value from property rights centrism to property rights ecologism and guide the healthy return of global intellectual property competition,this paper suggest the following measures.First,carry out micro behavior correction,constructing a“quality contribution”oriented behavior incentive mechanism,and replacing the“creativity”standard with the“technical substantive progress”standard.Second,design mid-scale rules,establish a“competition cooperation”intellectual property innovation ecosystem,and unify the profit distribution mechanism of the innovation ecosystem chain.Third,carry out macro policy reforms and use a“diversified development”governance system to promote the development-oriented reform of the global intellectual property governance system.
