Existing Problems in the Application of Scientific Data Sharing License Agreements and Suggestions for Improvement-Taking 20 National Scientific Data Centers as Examples
Abstract:China's scientific data resources have formed a scale advantage,yet their sharing efficiency has not been fully unleashed.As the core carrier for regulating sharing behaviors,scientific data sharing license agreements can be categorized into contract-based,declaration-based,general-purpose,and specific-purpose types.A survey of 20 national scientific data centers shows that the current agreements face problems such as ambiguous legal effect,unclear definition of rights and obligations,and insufficient compatibility,which have become major obstacles to data sharing.To address these problems,targeted optimizations are required:clarifying legal effect by strengthening notification and confirming the validity of general agreements;defining rights and obligations explicitly by delineating the rights and responsibilities of subjects and formulating standards and norms;and improving compatibility through establishing coordination mechanisms and promoting awareness.Furthermore,this will break down the barriers to scientific data sharing,promote the orderly flow of scientific and technological resources,and provide support for the high-quality development of scientific research undertakings.
