Abstract Currently, competitive form of patent has developed from the traditional patent-arms race to patent market forces.In the patent market, patent intermediaries, based on different motives, create a variety of new business models, which promote or hinder the realization of the purpose of patent law to some extent.Patent brokerage promotes innovative activities through boosting transactions and enhancing value.Offensive patent aggregation shows to hinder or undermine the patent market performance.Defensive patent aggregation can help to reduce the threat of litigation, but it also has the possibility to form monopolies through price collusion against external competitors.Countries can make choice of policies based on different development stages, in order to consist patent intermediaries with patent system.
