Abstract：On the basis of the PSR theory,this paper studies on the transition of China's intellectual property rights system and its motivations.The paper finds that China's intellectual property rights system experienced the transition from passive transplantation to active change.The external motivation of Sino-US trade issues and the requirements of entry into WTO,and the internal motivation of China's innovation-driven development,the Belt and Road Initiative,the development of market economy,and other political,economic and technical motivations together promoted the reform and development of China's intellectual property rights system for forty years. Currently,the rise of the new technological revolution has brought many challenges to the field of intellectual property,and also put forward higher requirements to China's intellectual property rights system.
