3D打印时代数字化专利侵权及补偿机制研究

Abstract Convenient private manufacturing and the digital trends of patents’ expressions in the era of 3D printing may trigger large-scale,geographically dispersed patent infringement.Existing exclusive measures,“ex post sue”or“ex ante review”,raise the operating cost of the patent system sharply and intensify the contradiction between right holders and the public.By forming patent compensation system,private manufacturing behavior separated from the original uncertainty of the legal status.The patent compensation system brings printed materials in the object of compensation and shares the compensation according to the market which is reflected by the CAD drawing download flow.The patent compensation system can meet the two-way needs:the public can carry out private manufacturing conveniently,participate in innovation,and the patentee can obtain the full remuneration.
