Abstract Plant variety protection is an important component of the national intellectual property strategy and the strategy of science and technology.It is an important source of power to promote agriculture science and technology innovation.To inspire the enthusiasm of plant breeders, developed countries have taken the lead in establish related laws and regulations, and has formed distinctive new plant varieties protection system.This paper summarizes the main type of international new plant varieties protection system, and compares the difference between patent protection and UPOV convention.It analyzes the achievements and existing problems of the system of new plant varieties in China, and puts forward suggestions to consummate the system of new plant varieties in China
