人脸识别个人信息的倾斜保护

Abstract The application of facial recognition technology has certain rationality,but it also puts the sensitive information of face at risk.Under the autonomous protection norms,the protection of personal information in facial recognition is faced with institutional dilemmas such as the failure of “informed consent”rule,the imbalance of reasonable trust relationship and the Mismatch of relief mechanism.Out of the predicament,the personal information protection mode of facial recognition can be turned to “inclined protection”:to strengthen protection by inclined allocation of rights and obligations,on the one hand,to ensure the meaningful right to know and make choice;On the other hand,those who process information are subject to “fiduciary duty”,to clarify the special trust relationship between the two parties and enhance their duty of care and diligence as managers;At the same time,the relief system guarantees the information subject with the principle of advantage and convenience.In this way,it can restore the substantive equality between the information giver and receiver in the facial recognition application scenario,promote the balance of interests between the strong and the weak,and move towards a fair and just legal order.
