共享经济视角下的专利开放许可实践及制度价值

Abstract Due to the monopolizing characteristic of patent right,it is very difficult to share the technology.Open patenting licenses which developed from goods sharing and software open source are the most powerful response to technology sharing.The analysis of the main models of sharing economy and open source projects shows that the lack of technology sharing not only hinders the application and transfer of innovation results,but also brings obstacles to the development of existing shared projects.Open patenting licenses make the transfer and implementation of technology much more convenient,and this kind of practice has been developed in the field of computer software,bioengineering and green technology.It is very hard to assess the results of those practices right now,but from the perspective of value for innovation,open patenting licenses can not only promote the real transfer and the implementation of the new technology,but also can bring us new innovation mode.Meanwhile,open patenting license can provide some new profit source for enterprises.
