Abstract At present,China's defense science and technology achievements transformation work still faces practical problems such as low efficiency in transformation and application,and the widespread existence of idle defense patents.At the theoretical level,establishing an open licensing system helps to promote the transformation and implementation of patents from the institutional supply mode,realizing their economic value.At the institutional level,how the “Defense Patent Regulations”apply the open licensing rules introduced after the revision of the “Patent Law”has become a key issue that urgently needs to be resolved.By analyzing the basic principles of the patent open licensing system,and in conjunction with the background of the revision of relevant legal systems in China,this paper analyzes and demonstrates the necessity and feasibility of using the open licensing system in the defense patent system,and proposes a suggested plan for the defense patent open licensing system.
