中国《专利法》第四次修改的焦点及其争议

摘要正在进行的中国《专利法》第四次修改的焦点与争议内容主要涉及:强化专利行政保护、扩大专利行政机关的职权;引入惩罚性赔偿;专利无效宣告请求审查决定的即时生效。尽管中国当前专利保护不力,但强化专利行政保护并非解决问题的正途,扩大专利行政机关的保护职权将弊大于利。为解决“赔偿低”问题,有必要引入惩罚性赔偿,但同时也需防范其可能催生“专利流氓”等负面影响。修订草案明确规定专利无效宣告请求审查决定做出后即时生效,但这一修改的必要性和可行性均值得怀疑,设立知识产权法院或许是更为可行的解决之道。

Abstract：The main disputes in ongoing fourth amendment of Chinas patent law include:strengthening the patent administrative protection,expanding authority of patent administrative agency,introducing punitive damages,and confirming the decision of patent invalidation request for review becoming effective immediately.Although our current patent protection is ineffective,however,to strengthen the protection of patent administration is not the right path to solve problems.To solve the“low compensation”problem,it is necessary to adopt punitive damages,but also need to guard against the possible birth of “patent trolls” and other negative effects.The amendment draft clarifies that the decision of patent invalidation request to review with immediate effect,but the necessity and feasibility of this modification are questionable.Establishment of intellectual property court is probably more effective solution
