Research on the Ownership of Intellectual Property Rights in Government-Enterprise Joint Funds at the Local Level in China——A Case Study of the Enterprise Joint Fund of the Natural Science Fund of China

Abstract:As a distinctive category within China's National Natural Science Foundation system,government-enterprise joint funds involve enterprises contributing capital to support basic research while simultaneously asserting claims over the intellectual property rights arising from funded projects.While addressing this issue,local institutes in China have designed three main models:attributing ownership to the project undertaker,adhering to relevant national and local laws and regulations,or recognizing contractual arrangements as prevailing.Among these,most provinces have opted for the“contract-prevails”model.This paper argues,based on the demonstration that government-enterprise joint fund projects fall within the category of science and technology programs funded by government finance,that the ownership of intellectual property cannot be allocated to enterprises through a“contract-prevails”model,as such an arrangement would exceed the statutory authorization established under the Law on Scientific and Technological Progress.Building on the fundamental premise of“statutory ownership”,this paper proposes a“tripartite rights integration”mechanism effectively allocating usage and benefit rights,thereby fulfilling the original purpose and institutional objectives of establishing government-enterprise joint fund projects.
