Institutional Review and Rule Optimization of the Exclusive Rights Regime in Layout-Designs of Integrated Circuits ——With Comments on Selected Provisions in the Draft Amendments to the Regulations on the Protection of Layout-Designs of Integrated Circuits

Abstract:Although the Regulations on the Protection of Layout-Designs of Integrated Circuits once spurred the rapid rise of China's semiconductor industry,their institutional design now lags behind technological progress and market needs.A review of the current framework shows that,while the Regulations outline the basic structure of layout-design protection,a gap between protective intent and industrial reality limits their legal effectiveness.The regime suffers from outdated positioning,ambiguous ownership,narrow rights,and inadequate damages rules,along with administrative inefficiency and inconsistent judicial practice.The Draft Amendments to the Regulations on the Protection of Layout-Designs of Integrated Circuits(for Public Comment)propose revisions but there remains room for improvement.To address these deficiencies,further refinement should focus on the determination of creator status and rules on commercial markings,the electronic archiving and evidentiary preservation of registration materials,clearer conditions for fair use and reverse engineering,and industry cultivation and policy support,thereby advancing rule optimization and improving the effectiveness of the regulatory framework.
