Abstract During the period of 1985—2013,the Patent Reexamination Board of SIPO had made a total of 2035 invention patents invalid decisions.This paper made a comparative analysis on the invalidity and related patent characteristics of domestic and foreign invention patents involved in the 2035 patents invalid decisions.The empirical results show that the stability of domestic patents is better than that of foreign patents,however foreign patent holders are good at strategically using patent claims to guarantee the patent stability.Besides,the domestic and foreign invention patents above are divided into two groups according to their patent invalidity,the distributions of patent characteristics which are patent age,number of patent claims,size of patent family and number of IPC,all exhibit significant differences in both groups for domestic and foreign invention patents
