论国际法协调互联网权利与网络主权的进路反思与重构

Abstract The relation between internet rights and cyber sovereignty is complicated.International law tried to harmonize internet rights and cyber sovereignty from the reformation of international political,economic and legal orders after World War II.It can be broken down into three major periods:the emerging period,the struggling period and the internet era.There are many obstacles,such as divergent judgment on the theoretical value of “sovereignty”and “human rights”,disagreement over conditions for the restriction of internet rights,the fragmentation of the coordination platform.The reconstruction may include:keeping faith with “sovereignty as a responsibility”,distinguishing different international guidance documents,and adhering to the United Nations as the core platform.
