Abstract Big data is increasingly important in economic and social development.The efficient use of all data from multiple sources is the source of value for big data.However,most big data practices have not been fully documented and disclosed.Our intellectual property system has not yet properly configured this resource to achieve the goal of encouraging technology disclosure in this new area.The existing intellectual property paradigm is not the best choice for protecting big data.By setting a big-data right,the conflict between data disclosure and intellectual property protection can be better solved, big data resources can be fully utilized.
